Terms of Use

Last Updated: October 30, 2026

These Terms of Use (these "Terms") between Chem Dating, Inc., a Delaware corporation ("Chem," "we," or "us"), and "you" govern your use of the Chem mobile application, chemdating.com, and all related pages, features, and tools (the "Platform"), the Materials, and our services, including account creation, profile and video creation, video hosting and display, matching, likes, messaging, and safety and reporting tools (the "Services"). BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR OTHERWISE USING THE PLATFORM, YOU AGREE TO THESE TERMS AND ACKNOWLEDGE THE CHEM PRIVACY POLICY AVAILABLE IN THE APP AND AT CHEMDATING.COM (THE "PRIVACY POLICY"). IF YOU DO NOT AGREE, YOU MAY NOT USE THE PLATFORM. PLEASE READ SECTION 19 CAREFULLY. IT REQUIRES YOU AND CHEM TO RESOLVE DISPUTES THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION, EXCEPT AS DESCRIBED IN SECTION 19. YOU MAY OPT OUT UNDER SECTION 19(i).

The Platform is an asynchronous video service for adults seeking dating or friendship connections. It lets adults create a profile, record and share short videos, discover other members, express interest, and message members with whom they match. Members and anyone else who accesses the Platform are "Users." Our Community Guidelines (the "Community Guidelines") and Safety Tips (the "Safety Tips"), each available in the app and on our website, are incorporated by reference into these Terms. The Privacy Policy is not a contract term except as law requires.

1. Accounts and Registration. You must register for an account and create a profile to use most Services. You agree to keep all information you provide accurate, current, and complete, and we may verify it as described in the Privacy Policy. You may maintain only one account, and you may not create an account for anyone else or use another person's account. You are responsible for safeguarding your login credentials and devices and for all activity under your account, and must promptly report any suspected compromise to info@chemdating.com, and we are not liable for losses from your failure to safeguard your credentials. You create and access your account by signing in through Apple or Google, and you authorize us to access and use information from that service as its terms, your settings, and the Privacy Policy permit.

2. Eligibility; Age Requirement. You must be at least 18 years old and able to form a binding contract to create an account or use the Platform, and no one may accept these Terms for anyone under 18. By using the Platform, you represent and warrant that (a) you are at least 18; (b) you have never been convicted of a felony or of any crime involving violence, sexual misconduct, or the exploitation of a minor, and are not required to register as a sex offender with any government entity; (c) you have not previously been removed from the Platform by us, unless we have given you written permission to return; (d) you are not barred by law from using the Platform; and (e) you are not located or ordinarily resident in a country or region subject to comprehensive U.S. sanctions or on any U.S. government restricted-party list. You must provide your date of birth when you create an account, we may take reasonable steps to confirm a User's age, and we will terminate the account of, and delete the personal information of, any User we learn is under 18. The Platform is currently available only to Users located in the United States and may be available only in certain cities or regions within the United States. The Platform is for personal, non-commercial use only.

3. Copyright. The Platform, the Services, and all related software, content (other than User Content), designs, text, graphics, interfaces, features, and data compilations (the "Materials"), and all intellectual property rights in them, are owned by Chem or its licensors. Except as these Terms expressly permit, the Platform and Materials may not be modified, reproduced, distributed, displayed, performed, or otherwise used, in whole or in part, without Chem's prior written consent. Subject to your compliance with these Terms, Chem grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use one copy of the mobile application on a device you own or control, and to access and use the Platform, solely for your personal, non-commercial use. No other rights are granted by implication, estoppel, or otherwise.

4. Trademarks. "Chem," "Chem Dating," and all related names, logos, product and service names, designs, and slogans (the "Trademarks") are Chem's trademarks. You may not display, make reference to, or use them, including as a hyperlink, without Chem's prior written permission. Other marks on the Platform belong to their owners.

5. The Platform and Chem's Role. Chem provides a venue for adults to meet and communicate, whether for dating or friendship. Chem is not a party to, and is not responsible for, any communication, relationship, meeting, or other interaction between Users, whether on or off the Platform. Chem does not guarantee that you will receive any likes, matches, messages, or dates, the number of Users in any area, or the accuracy of any profile, video, or other User Content, and does not endorse any User. Content on the Platform, including any dating or safety tips, is general information and not legal, medical, psychological, or other professional advice. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Chem. We may, in our discretion, decline to show any profile or video, limit any feature, or remove any profile.

6. Videos, Profiles, and Messages; Your License to Us. You are solely responsible for all information and materials you submit to or through the Platform, including your profile information and profile photo, videos (including your image, likeness, and voice as they appear in your videos), captions, prompts and responses, likes, messages, reports, and other content ("User Content"). You represent and warrant that you own or have all rights necessary to provide your User Content and grant the licenses in these Terms (including the consent of any other person who appears in or is identifiable from your User Content), that it is accurate and not misleading, and that it, and our use of it under these Terms, will not violate any law, these Terms, the Community Guidelines, or any third party's rights.

You retain ownership of your User Content. You grant Chem and its affiliates a worldwide, non-exclusive, royalty-free, fully paid, transferable license, sublicensable to our service providers (such as our cloud storage, database, and video delivery providers) solely to the extent necessary for them to provide services to us, to host, store, reproduce, process, encode, transcode, combine, format, adapt (including to create thumbnails and previews), transmit, display, and perform your User Content in connection with operating, providing, securing, moderating, and improving the Platform and Services, enforcing these Terms, and as otherwise described in these Terms and the Privacy Policy. This license includes the right to display your profile and videos to other Users and to deliver your messages to their intended recipients. This license ends when you delete the applicable User Content or your account, except for copies we retain as described in the Privacy Policy, including limited records of reported content that we keep for safety, legal, and enforcement purposes. When you delete your account, your conversations with other Users, including the messages you sent and received, are deleted for all participants.

Exported Videos; Reposting. The Platform may allow you to export your own videos to your device. Exported videos include a Chem watermark and end card. You may export only your own videos, not any other User's User Content, and you may share your exported videos outside the Platform at your own discretion and risk, subject to the terms of any service where you post them. If you post an exported video or other content and tag, mention, or otherwise identify Chem (including by using a hashtag we designate), you grant Chem a non-exclusive, royalty-free, worldwide license to repost, share, and display that content on Chem's social media accounts and website and in other promotional materials for Chem, with attribution to you where practicable, and you represent that you have all rights needed for us to do so. You may ask us to stop using that content at any time by contacting info@chemdating.com, and we will stop new uses within a reasonable time, but we are not required to remove copies already posted or distributed. Except as described in this paragraph or with your separate consent, we will not use your videos, name, or likeness in advertising or promotional materials outside the Platform.

Each User grants every other User a limited, non-exclusive, revocable license to view that User's User Content solely within the Platform as the Platform's features permit. You may not download, screenshot, screen record, copy, share, post, or otherwise use another User's User Content outside the Platform without that User's express consent. You grant Chem a perpetual, irrevocable, worldwide, royalty-free right to use any suggestions or feedback about the Platform or Services for any purpose without obligation to you. We may review, remove, or refuse to display any User Content at any time for any reason, but we have no obligation to monitor it.

7. Community Guidelines; Prohibited Conduct. You must comply with these Terms and the Community Guidelines, treat other Users with respect, and use the Platform only for its intended purpose. You may not, and may not permit or assist anyone else to:

i. Violate any applicable law, including laws on harassment, stalking, privacy, intellectual property, anti-spam, and export controls and sanctions;

ii. Provide false or misleading information, impersonate any person, misrepresent your identity, age, appearance, relationship status, or intentions (including the type of connection you are seeking), create a fake or duplicate account, or use photos, videos, or voices of anyone other than yourself;

iii. Post or send any content that is pornographic, sexually explicit, or contains nudity, or that depicts, sexualizes, or endangers anyone under 18;

iv. Use a friendship connection to pursue romantic or sexual contact with a User who has not indicated they are open to it, or continue to pursue romantic or sexual contact after a User has declined or not responded;

v. Harass, bully, stalk, threaten, intimidate, defame, or abuse anyone, or post or send content that is hateful, discriminatory, violent, or that promotes or glorifies self-harm, terrorism, or violence;

vi. Solicit money, gifts, financial information, or other things of value from any User, engage in any scam, romance fraud, or investment or cryptocurrency scheme, or offer, request, or advertise any commercial sexual activity, escort service, or sugar-dating arrangement;

vii. Use the Platform for any commercial purpose, including advertising or soliciting for any product, service, or business, directing Users to paid or subscription content, or recruiting Users for any other dating or social service (sharing your social media handles with Users you connect with is permitted, but you may not use the Platform primarily to promote your social media accounts, content, or business);

viii. Disclose another person's private or personal information (including their address, phone number, location, workplace, or sexual orientation) without their consent, or share or threaten to share intimate images of anyone without their consent;

ix. Create, post, or send any synthetic, AI-generated, or digitally altered image, video, or audio that depicts a real person without that person's consent, or that materially misrepresents your own identity or appearance;

x. Download, screenshot, screen record, copy, scrape, crawl, harvest, or extract data or User Content from the Platform, by automated means or otherwise, except through features we provide for that purpose;

xi. Use bots, scripts, or other automated means to access the Platform, create accounts, send likes or messages, or interact with Users;

xii. Modify or create derivative works of the Trademarks or Materials, or reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or structure of the Platform, except as law expressly permits notwithstanding this restriction;

xiii. Bypass, circumvent, disable, or interfere with any security, age, moderation, blocking, or other technical measure, or gain or attempt to gain unauthorized access to any part of the Platform or any other User's account;

xiv. Introduce harmful code, interfere or attempt to interfere with the Platform or anyone's use of it, or take any action that imposes, or may impose (in our sole discretion), an unreasonable load on our infrastructure;

xv. Sell, transfer, rent, or otherwise commercially exploit your account or access to the Platform; or

xvi. Use the Platform, the Materials, or any User Content to build, train, benchmark, or improve any competing product or service or any AI or machine learning model.

8. Moderation, Reporting, and Enforcement. We review reports of User Content and conduct that may violate these Terms or the Community Guidelines, and we may also review User Content on our own initiative, but we do not pre-screen User Content, cannot review all of it, and do not guarantee that it complies with them. You can report any profile, video, or message you see, and block any User you have matched with, through the Platform, or report a User by emailing info@chemdating.com. Reporting a User also blocks that User from your view. If we believe you have violated these Terms, the Community Guidelines, or any law, or that your conduct creates risk for Chem or other Users, we may, without notice, remove or restrict your User Content, limit your use of any feature, or suspend or terminate your account, and may prohibit you from creating a new account. We may preserve and disclose User Content and account information to law enforcement or others as described in the Privacy Policy, and we report apparent child sexual exploitation to the National Center for Missing & Exploited Children as law requires. If we remove a User for fraudulent activity, we may notify Users who communicated with that User, as law requires.

9. Safety; No Criminal Background Screening; Interactions with Other Users. Your safety matters to us, and we encourage you to review our Safety Tips in the app before communicating with or meeting anyone.

CHEM DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS, SEX OFFENDER REGISTRY SEARCHES, OR IDENTITY VERIFICATION OF ITS USERS OR MEMBERS, AND DOES NOT VERIFY THE STATEMENTS USERS MAKE ABOUT THEMSELVES.

You are solely responsible for your interactions with other Users, both on and off the Platform, including any decision to share personal information or to meet in person. Use caution and common sense: do not send money or financial information to anyone you meet on the Platform, meet for the first time in a public place, tell a friend or family member your plans, and arrange your own transportation. These precautions apply equally to friendship connections. Chem does not supervise and is not responsible for the conduct of any User, and does not make any representation or warranty about any User's identity, intentions (including whether a User is seeking friendship, dating, or both), background, or conduct. If you believe you are in danger, contact local law enforcement immediately, and then report the User to us.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE THE CHEM PARTIES (DEFINED IN SECTION 14) FROM ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND, KNOWN AND UNKNOWN, ARISING OUT OF OR RELATING TO ANY DISPUTE WITH, OR THE CONDUCT OF, ANY OTHER USER OR THIRD PARTY, ONLINE OR OFFLINE, INCLUDING ANY IN-PERSON MEETING. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY," AND ANY SIMILAR LAW OF ANY OTHER JURISDICTION.

10. Matching; Connection Types; No Biometric Processing. You can choose whether you are interested in dating, friendship, or both. If you choose both, you can switch between a dating feed and a friendship feed, and your videos may appear in either feed based on your settings. A match is a dating match or a friendship match depending on the feed where both Users liked each other. If both Users in a friendship match indicate in the chat that they are "open to more," the match becomes a dating match. Within each feed, we show you profiles and videos based on your gender and the gender(s) you are interested in, which we apply mutually (so you will see only Users whose preferences include you, and they will see you only if your preferences include them). We also show you only Users within the age range and distance settings you choose (these settings control who you see, not who sees you), and we rank profiles and videos based on factors such as your distance from other Users and whether a User has liked you. We do not guarantee that you will see any particular User or that any User will see you. Chem does not use facial recognition technology, does not create face templates or other biometric identifiers from your videos or other User Content, and does not use facial features or other biometric characteristics to match, rank, or recommend Users. Any filter in our video recorder applies uniformly to the entire frame and does not detect, map, or analyze facial features. See the Privacy Policy for more information.

11. Paid Features. The Platform is currently free to use. If we offer paid features in the future, we will tell you the price and applicable terms before you make any purchase and will update these Terms as needed.

12. Links; Third-Party Services. The Platform may link to or integrate with third-party services, including app stores, sign-in providers, cloud hosting and storage, video delivery, analytics, and messaging providers ("Third-Party Services"). Chem does not control, makes no representations or warranties regarding, and is not responsible or liable for Third-Party Services or any loss from your dealings with them, which are subject to their own terms and solely between you and the third party.

13. Mobile App; App Store Terms. If you download the Chem app from the Apple App Store, you and Chem acknowledge that (a) these Terms are between you and Chem only, not Apple Inc. ("Apple"), and Chem, not Apple, is solely responsible for the app and its content; (b) your license to use the app is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; (c) Apple has no obligation to provide maintenance or support for the app; (d) if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the app, and, to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; (e) Chem, not Apple, is responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws; (f) Chem, not Apple, is responsible for the investigation, defense, settlement, and discharge of any claim that the app or your use of it infringes a third party's intellectual property rights; (g) you represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and are not on any U.S. government list of prohibited or restricted parties; (h) you must comply with applicable third-party terms (such as your wireless data service agreement) when using the app; and (i) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you download the app from Google Play or another app store, that store's terms also apply to your download and any purchases.

14. Indemnification. To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Chem, its affiliates, and their officers, directors, stockholders, employees, contractors, and agents (the "Chem Parties") from and against all third-party claims, demands, and proceedings, and all related losses, damages, liabilities, fines, costs, and expenses (including reasonable attorneys' fees), arising out of or relating to your User Content, your breach of these Terms or applicable law, or your interactions with any other User. We will give you reasonably prompt notice of any such claim (though delay relieves you only to the extent it materially prejudices you). Chem may assume the exclusive defense and control of any such matter at your expense, and you will cooperate with us. You may not settle any claim that imposes an obligation on or admits fault by any Chem Party without our prior written consent.

15. Disclaimer of Warranties. THE PLATFORM, SERVICES, MATERIALS, AND USER CONTENT (THE "CHEM ASSETS") ARE PROVIDED "AS IS" AND "AS AVAILABLE," AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, CHEM DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, AND DOES NOT WARRANT THAT THE CHEM ASSETS WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, THAT ANY USER CONTENT OR PROFILE IS ACCURATE, COMPLETE, OR AUTHENTIC, THAT ANY USER'S STATED INTENTIONS OR CONNECTION PREFERENCES ARE GENUINE, OR THAT YOU WILL FIND A MATCH OR RELATIONSHIP. CHEM IS NOT RESPONSIBLE FOR THE CONDUCT, STATEMENTS, OR CONTENT OF ANY USER, ONLINE OR OFFLINE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NO CHEM PARTY WILL BE LIABLE TO YOU OR ANYONE CLAIMING THROUGH YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, OR ANY DAMAGES FOR EMOTIONAL DISTRESS OR PERSONAL INJURY ARISING FROM THE CONDUCT OF ANY USER OR THIRD PARTY, ARISING OUT OF OR RELATING TO THESE TERMS, THE CHEM ASSETS, OR ANY INTERACTION WITH ANY USER, UNDER ANY THEORY (INCLUDING CONTRACT, TORT, NEGLIGENCE, AND STRICT LIABILITY), EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) THE CHEM PARTIES' TOTAL AGGREGATE LIABILITY, HOWEVER ARISING, WILL NOT EXCEED THE GREATER OF US $100 AND THE AMOUNTS YOU PAID TO CHEM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations are an essential basis of the bargain, apply even if a limited remedy fails of its essential purpose, and do not limit any liability that cannot be limited under applicable law, including for fraud or for death or personal injury caused by a Chem Party's gross negligence or willful misconduct. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

17. Changes to Platform. Chem may, in its sole discretion and with or without notice, modify, suspend, interrupt, or discontinue all or part of the Platform, temporarily or permanently, without liability to you or any third party.

18. Changes to Terms of Use. We may modify these Terms. We will give at least thirty (30) days' notice of material changes by email, in-app notice, or other reasonable means, except that changes required by law or for safety or security may take effect immediately. Changes are not retroactive, your continued use after they take effect constitutes acceptance, and if you do not agree you must stop using the Platform and delete your account. Changes to Section 19 are subject to Section 19(j).

19. Applicable Law, Jurisdiction and Claims. THESE TERMS ARE GOVERNED BY ILLINOIS LAW, WITHOUT REGARD TO CONFLICT OF LAWS PRINCIPLES, AND THIS SECTION 19 IS GOVERNED BY THE FEDERAL ARBITRATION ACT. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

(a) Informal Resolution. Before starting any proceeding, a claimant must send the other party written notice with the claimant's name, account email address, a description of the claim, and the relief sought (to Chem at legal@chemdating.com and [MAILING ADDRESS]). The parties will try in good faith to resolve it for 60 days after receipt, including by video or telephone conference if either requests, and limitation periods and filing deadlines are tolled during this period.

(b) Agreement to Arbitrate. Except as provided in Section 19(f), any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or your relationship with Chem, under any legal theory and whenever it arose (a "Dispute"), will be resolved exclusively by final and binding individual arbitration. THIS MEANS THAT YOU AND CHEM ARE EACH GIVING UP THE RIGHT TO HAVE A DISPUTE DECIDED IN COURT BY A JUDGE OR JURY, EXCEPT AS PROVIDED IN SECTION 19(f).

(c) Rules and Forum. The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules, as modified by this Section 19 (the "AAA Rules"), before a single arbitrator. The arbitration will take place in the county where you reside or, at your election, by video or telephone, unless the parties agree otherwise. The arbitrator may award any individual relief a court could award, but only as necessary to resolve the claimant's individual claim. Judgment on the written, final, and binding award may be entered in any court of competent jurisdiction.

(d) Delegation. The arbitrator has exclusive authority to resolve all disputes about the interpretation, applicability, enforceability, or formation of this agreement to arbitrate, except that a court will decide whether Section 19(e) is enforceable, any issue under Section 19(h) that the AAA Rules reserve to a court, and whether a claim falls within Section 19(f).

(e) Class Action and Jury Trial Waiver. YOU AND CHEM MAY BRING DISPUTES ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, AND EACH WAIVES THE RIGHT TO A JURY TRIAL. Except as provided in Section 19(h), the arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding. If a court finds this Section 19(e) unenforceable as to any claim or relief, that claim or relief will be severed and decided by a court under Section 19(l) after individual arbitration of all other claims is complete.

(f) Exceptions. Either party may bring an individual claim in small claims court if it qualifies and remains there, seek injunctive or other equitable relief in court to protect its intellectual property or to enforce Section 7, or seek interim relief in court in aid of arbitration.

(g) Fees. AAA fees are governed by the AAA Rules, under which Chem will pay all administrative and arbitrator fees other than any initial filing fee the AAA Rules allocate to you. If you show that arbitration costs would be prohibitive compared to litigation, Chem will pay as much of your share as the arbitrator deems necessary to prevent that. Each party bears its own attorneys' fees unless the arbitrator awards them under applicable law or the AAA Rules or finds a claim or defense frivolous or brought for an improper purpose.

(h) Mass Arbitration. If 25 or more substantially similar demands are filed against Chem by or with the assistance of the same or coordinated counsel or organizations, the AAA's Mass Arbitration Supplementary Rules (or current equivalent) apply, and the demands will proceed in batches of no more than 50, one arbitrator per batch and one batch at a time, with remaining demands (and their fees) held in abeyance and limitation periods tolled until assigned to a batch. The parties may still agree to a global mediation or settlement.

(i) 30-Day Opt-Out. You may opt out of arbitration by emailing legal@chemdating.com from the email address associated with your account, with your name and a clear opt-out statement, within 30 days after you first agree to these Terms, in which case Section 19(l) governs all Disputes, and neither the rest of these Terms nor any other arbitration agreement with Chem is affected.

(j) Changes. A material change to this Section 19 will not apply to any Dispute of which Chem had actual notice before it took effect, and you may reject it by written notice to legal@chemdating.com within 30 days after it takes effect, in which case the prior version continues to apply to you.

(k) Time Limit; Survival; Severability. To the extent permitted by law, any Dispute must be commenced within one year after the claim arises or it is permanently barred. This Section 19 survives termination. Except as provided in Section 19(e), any unenforceable part of this Section 19 will be severed and the rest enforced.

(l) Courts. Any Dispute not subject to arbitration (including if you opt out) will be brought exclusively in the state courts located in Cook County, Illinois, or the United States District Court for the Northern District of Illinois, and the parties consent to their jurisdiction and venue and waive any inconvenient-forum objection. Either party may also seek relief in those courts as Section 19(f) permits.

20. Termination; Account Deletion. You may delete your account at any time in the app's account settings, on our website at chemdating.com, or by emailing info@chemdating.com. Deleting the app from your device does not delete your account. When you delete your account, we will delete your profile, videos, and associated data as described in the Privacy Policy. Chem may suspend or terminate your access, or remove your profile or User Content, at any time, with or without notice, if we believe you have violated these Terms, the Community Guidelines, or any law, or that your conduct creates risk or potential legal exposure for Chem or other Users, or for any other reason in our sole discretion. On termination, your license to use the Platform ends immediately, although we may retain and use information as described in the Privacy Policy and as law requires or permits. Sections 3 (other than the limited license), 4, 6 (as to retained User Content and feedback), 7, 9, 14 through 16, 19, and 21 through 24, and any other provisions that by their nature should survive, survive termination.

21. Force Majeure. Chem is not responsible for any damages, delay, or failure in performance caused by events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government action, labor disputes, utility or internet failures, cyberattacks, and failures of Third-Party Services.

22. Copyright Complaints. Chem responds to notices of alleged copyright infringement that comply with 17 U.S.C. § 512(c)(3), sent to our designated agent at Attn: Copyright Agent, Chem Dating, Inc., [MAILING ADDRESS], legal@chemdating.com, and may terminate the accounts of repeat infringers in appropriate circumstances.

23. Notice; Electronic Communications. You consent to receive notices and communications electronically, including by email to the address associated with your account or any other address you provide, push notification, in-app notice, or posting on the Platform, and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. You may withdraw this consent by deleting your account. Send legal notices to legal@chemdating.com, with a copy to [MAILING ADDRESS].

If you enable push notifications, we will notify you of new matches and messages, and you can turn off push notifications at any time in your device settings. We send account-related emails (such as notices about these Terms or your account) to the email address associated with your account, but we do not send marketing emails to that address. If you join our waitlist or otherwise provide your email address on our website, we may send you marketing emails about Chem, and you can unsubscribe at any time using the link in any such email.

24. General Provisions. You will comply with all applicable laws. These Terms (including the Community Guidelines and Safety Tips) are the entire agreement between you and Chem regarding the Platform and supersede all prior and contemporaneous understandings on that subject. You may not assign or transfer these Terms without our prior written consent, and any attempt to do so is void, but we may assign them without restriction, including in a merger, acquisition, reorganization, or asset sale. No waiver of any default waives any other default. Except as provided in Section 19(e), any unenforceable provision will be enforced to the maximum extent permissible, and the rest of these Terms will remain in effect. Except for the Chem Parties under Sections 9, 14, and 16, and Apple and its subsidiaries under Section 13, there are no third-party beneficiaries. Headings are for convenience only, "including" means "including without limitation," and "or" is not exclusive. Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.

Questions about these Terms may be sent to Chem Dating, Inc., [MAILING ADDRESS], info@chemdating.com.
